The Subclass 309 (Provisional) and Subclass 100 (Migrant) Partner visas are a two-stage pathway that lets married, engaged or de facto couples reunite by applying from outside Australia. You begin living in Australia with your partner, who is an Australian citizen, permanent resident or eligible New Zealand citizen. The provisional Subclass 309 is granted first; as you demonstrate that your relationship is genuine and ongoing, the permanent Subclass 100 is assessed.

Sponsorship: Your partner must be an Australian citizen, permanent resident or eligible New Zealand citizen and undertake to support you throughout the application.
Offshore application: You are generally expected to be outside Australia when the application is lodged.
Health and character: Both you and your partner must meet the health and character standards; a medical examination and police clearances are provided.
Two-stage process: The provisional 309 is assessed first; as the relationship continues, you move to the permanent 100 stage.
