Choosing a migration agent

Choosing a Migration Agent: What to Check Before You Engage

The right migration agent for you is registered, states plainly what they can and cannot promise, and is clear about who in the practice will actually work on your file. Office presentation, marketing material and unverifiable client lists are secondary considerations.

This page sets out what to check when choosing a migration agent, visa agent or migration consultant in Perth, so the decision is made on the facts rather than the pitch.

Confirm registration before anything else

In Australia, only a person registered with the Office of the Migration Agents Registration Authority (OMARA) — or an Australian legal practitioner — may lawfully provide immigration assistance for a fee. Every registered agent holds a Migration Agent Registration Number (MARN), checkable on the OMARA register before you sign anything.

Adam (Gürkan) Kocoglu, principal of Australian Migration Co, is a Registered Migration Agent, MARN 2418576. If an agent or consultancy cannot provide a MARN for you to verify, the engagement should not proceed.

Ask who actually handles your file

Some larger practices route matters through paralegals or case managers, with the registered agent reviewing at a distance. That structure can work well and is not improper, but it should be disclosed at the outset rather than discovered later. At Australian Migration Co, Adam personally handles the assessment, strategy and preparation of the matters he takes on. Ask any prospective agent who will draft your submission, and who will be named as your authorised recipient for correspondence with the Department.

Language access matters for some applicants

For a Turkish-speaking applicant, sponsor or family member, discussing a visa matter in your first language materially affects what is communicated and understood, particularly where the circumstances are complex or time-critical. Australian Migration Co provides services in English, with Turkish language support available where required.

Understand what no agent can promise you

Why this is a trust signal, not a limitation

An agent who promises approval, or implies influence over a case officer's decision, is making a claim no compliant agent can properly make. Treat an assurance of that kind as a warning sign rather than a reason to engage.

No registered agent may guarantee a visa outcome, and no business may make a misleading claim about the likelihood of success. What a registered agent can do is assess your eligibility against the applicable legal criteria, identify the risks in your matter, including a PIC 4020 issue, a Schedule 3 time limit, or a sponsorship obligation under Division 2.19 of the Migration Regulations 1994, and prepare the strongest compliant case available on the facts. That is a narrower undertaking than a promised approval, and it is the only one a registered agent can properly give.

What to check before you engage anyone

  • the agent's MARN, checked directly on the OMARA register
  • who will actually assess, draft and lodge your matter
  • whether any outcome has been promised, implied or guaranteed, which should be treated as a warning sign
  • whether the fee structure and scope of engagement are set out in writing before you commit
  • whether the practice can communicate with you in the language you are most comfortable using, where that matters to you

Questions people ask when choosing a migration agent

How do I check if a migration agent in Perth is actually registered?

Ask for their Migration Agent Registration Number (MARN) and check it on the OMARA register. Only a person registered with the Office of the Migration Agents Registration Authority, or an Australian legal practitioner, may lawfully provide immigration assistance for a fee. Adam (Gürkan) Kocoglu, principal of Australian Migration Co, is a Registered Migration Agent, MARN 2418576.

Can a migration agent guarantee my visa will be approved?

No. The Migration Agents Code of Conduct prohibits a registered agent from guaranteeing a visa outcome, and Australian Consumer Law prohibits misleading claims about the likelihood of success. An agent who promises approval is not representing the position accurately. A compliant agent instead assesses eligibility, identifies risk, and prepares the strongest case available on the facts.
